This page contains information about each of the three Committees that serve the Moorgate Point community: Board of Directors, Architectural Review Board, which includes Landscape, and Communications Manager. Architectural Review Board

Accountability

The Architectural Review Board (ARB) has the responsibility and authority for maintaining the landscaping and preserving the high architectural standards of Moorgate. The accountability ultimately rests with the Board of Directors.

Structure

The ARB shall consist of at least three persons to be appointed and replaced by the Board of Directors. The members of the ARB shall be residents in good standing of Moorgate Point.

Responsibilities and Duties

To approve or disapprove, by a majority of its members, applications made by residents for landscape and architectural changes to their property.

The ARB shall oversee that no exterior change or structure of any kind, including without limitations any gazebo, wall, vents, sky lights, fountain, shutters, swimming pool, screened enclosure, additional landscaping, exterior lights, landscape lights, change in paint colors or roof colors shall be erected, placed or maintained and no addition, alteration, modification, or change to any such improvement, landscaping or structure shall be made without the prior written approval of the ARB.

An application form shall be completed by the homeowner and submitted to the ARB through the management company. The application shall include a complete set of plans and specifications for proposed construction, alterations, additions. The plans shall include, but not necessarily limited to, as appropriate, the proposed location, grade, elevations, shape, dimensions, exterior color plans, landscaping plans, approximate costs and nature, type and color of materials to be used. The ARB may also request additional information as necessary for their proper review.

The ARB shall evaluate all plans solely as to the aesthetic quality, materials and workmanship to be used. A site visit may be conducted in order to assure suitability and harmony of location, structure and external design in relation to surrounding topography and structures. The ARB shall not be responsible for evaluating the structural safety or building code conformance or any other regulatory requirements of any proposal.

Approval or disapproval shall be in writing to the homeowner. In the event the ARB fails to approve or disapprove in writing any proposed plans within 30 days after submission/receipt to the ARB then said plans shall be deemed to have been approved. The management company shall facilitate the communication to the homeowner.

GUIDELINES

The ARB is empowered to publish or modify design and development standard guidelines and shall be responsible for seeing that these guidelines, as approved, by the Board of Directors are followed.

The guidelines shall be reasonable and in conformance with the plan of development of Moorgate Point neighborhood and Lely resort. A copy of the Document is available to homeowners and mortgagees on the website.

Enforcement

The use of fines and liens for enforcement purposes are described in the Declarations of CC&R’s, Page 36 & 37, Article 9. Any homeowner who disagrees with the ARB decision has the right to appeal the decision to the Board of Directors, whose ruling will be final and binding.

Any conflict between this document and the Bylaws, Articles or Declaration for Moorgate, shall be governed by the Bylaws Articles and Declaration respectively.

Communications Manager

Accountability

The Communications Manager is accountable to the Board for building goodwill within the neighborhood by keeping all Moorgate residents informed of association matters including news, meetings and events.

Structure

Any Member of the Association, in good standing, is eligible to be appointed by the Board of Directors as Communications Manager. Note, some Communications activities may overlap with the responsibilities of the Property Manager. Any areas of such conflict will be resolved by the Board.

Funding

All Communications expenditures shall not exceed or deviate from the approved budget without the approval of the Board of Directors. All receipts for expenditures must be submitted within 60 days of the expense.

Responsibilities and Duties

  1. Oversee the publication of the community newsletter in regards to its design, layout and distribution. The contents of the newsletter may vary but should include items that communicate important information to the homeowners, as well as items that encourage a sense of community. Review of the newsletter will be conducted by the Board of Directors before distribution.
  2. Develop and maintain the Association web site in accordance with the instructions of the Board of Directors.
  3. Establish and maintain an Association email distribution list.
  4. Establish and maintain an Association Member roster that meets Florida HOA Statutes.
  5. Keep the Association’s Key Contact Information current and send out updates to all owners as necessary.
  6. Work in cooperation with The Board and Association Committees to help them communicate events, activities and updates to the residents as required.
  7. Publish any community wide email notices or distributions as directed by the Board of Directors.
  8. Assemble a welcome package for new owners to be distributed by the Property Manager.
  9. Attend Board of Directors meetings and give Communications updates as appropriate.
  10. Attend the annual Association Members meeting and prepare and give a yearly report summary to the Members.
  11. Prepare and submit a proposed annual Communications budget for the following year to the Board.
